Immigration and single market access
Writing in the Telegraph, Szu Ping Chan asks whether the UK can curb immigration whilst maintaining unfettered access to the single market, post Brexit. Jonathan Lindsell, a research fellow at Civitas, suggests Britain could explore Article 28 of the EEA. “This explains that the free movement of workers is ‘subject to limitations justified on grounds of public policy, public security and public health,” he says. “The free movement of labour chapter specifies only ‘workers’, the ‘self-employed’ and ‘their dependants’, meaning there may be scope for a government to justify limiting jobless EEA migrants further,” Mr Lindsell adds. However, as Ms Ping Chan says, the EEA agreement points out that members must be “Determined to provide for the fullest possible realisation of the free movement of goods, persons, services and capital within the whole EEA”. The jury therefore, she concludes, is out.
