A solicitors’ firm that advised both partners in a cohabitation break-up was not negligent, an English county court has decided. Behrens J ruled that Kim Turner was given a full explanation of the agreed declaration of trust and had understood her position and need not have been advised to seek separate legal advice. Behrens J added that whether there is a duty to advise the clients on such an agreement depends on the facts of each case (Turner v Bromets Jackson Heath, 2016 EW Misc B15 CC).
