The England & Wales High Court has made an adverse costs order against a woman who insisted that her father’s will be proved in solemn form despite not raising a positive case against its validity. Ruth Simmonds invoked her right to cross-examine the attesting witness to Kenneth Jordan’s will, in which he had disinherited her and left his entire estate to his partner Bernice Elliott (Elliott v Simmonds & Tulip).
