Supreme court upholds ‘celebrity threesome’ injunction

An injunction banning the naming of a celebrity involved in an alleged extra-marital relationship should stay in place, the Supreme Court has ruled. The celebrity, known in court as PJS, successfully appealed against a court ruling lifting the ban on media in England and Wales publishing his name. Anthony Hudson QC of Matrix Chambers, a leading privacy barrister, described the ruling as a “terribly retrograde step which makes English judges look insular.” He predicts that the rich and famous would be “applying for injunctions left, right and centre” and adds: “There is no doubt we now have a full-on privacy law. This is a significant shift in the privacy landscape.” Tory MP Jacob Rees-Mogg said: “This is a legalistic hijack of our liberty as it reduces freedom of speech. I worry that the courts have given themselves the right to decide when free speech is in the public interest.” Meanwhile, the Guardian points out that Twitter users who named the “celebrity threesome” couple have begun to receive emails warning them of legal action following the ruling.
